Welcome to our RTA grievances and unfair labor practices page. As requested by our union members and executive board, the RTA would like to provide a place for our members to review and keep up to date with current grievances and unfair labor practices that are being addressed and pursued. Below you can find an update regarding the current state of grievance and ulps for our association.

Current Grievances:
– Grievance filed for the “Misuse and Contract Violation of PLG/Professional Time” with utilizing educators as coverage/substitutes.

– One grievance went to the School Committee concerning directed growth plan. School
Committee denied; Did not proceed to arbitration.

– Class action sick leave action: 2 individuals applied to use sick leave for medical conditions that
subjected them to increased risk if they got the vaccine (separate from reasonable
accommodations). Reinterviewed before students returned. Given 2 choices – take unpaid leave
or come in. Some members asked to use their sick leave, with medical documentation. School
Committee denied. Will go before the Grievance Committee on whether or not to proceed with
arbitration.

– Individual rights to file anti-descrimiation complaint with the state committee – denying
their rights under ADA.

Unfair Labor Practices:
– Filed Unfair Labor Practice Charge: if superintendent worked directly with the
membership about the survey sent to members regarding PLG. It’s a matter of
negotiations, and should have worked with RTA directly. Resolved: bring surveys to
RTA’s attention before sending out the teachers. The School Committee rejected our
settlement. Refiled

– During negotiations Superintendent – Negotiations Team said the district
was able to accommodate for some members medical needs for staying at home, but
not everyone (was based on positions). DK stated that they would have to reinterview
everyone about accommodations. THreatening response from DK. SC Attorny asked to
include in ground rules in our negotiations. When proposed by the Neg Team to address
this matter, it was rejected by the district (no counter proposal).

– Unfair labor charge investigation on union president by her principal. Targeting the Union
president. Was given Clarification of Expectations – has never been given before.

– Will send update on level 3 grievance regarding sick leave denial and update on status of ULP charges.
